Ok I've talked and told my advocate who told me to tell my lawyer who can not believe this has come from my GP . Honestly I have not seen a doctor that said I was king hit he hasn't seen anything either .

Just an update not much to say I was given two weeks off from therapy/rehab as the goings on got me so stressed . I already had the flu/virus which went into my good ear infected it and burst the ear drum .
Now while I've been home my eldest had been worried over my guess exemployer has not supplied my group certificate .
So contacted my lawyer and been waiting . Got a call from his assistant no answer but my exemployer was screaming blue murder basically I didn't give them a sickness certificate since July 20 my error . But while I'm not totally with it I was forced by rehab to get a Centrelink incapacitated certificate unlike late October 2016.
So I was going to take it in tomorrow checked my phone bus on south rd I had time to walk there it was late plenty of time .
So I got ready at 10.36 got there spoke to his assistant they copied it told her of changes I've made in my life not what I wish work to know so nothing online .
Home at 11.30am basically an hour two buses there and back woohoo .
Does make me wonder they can't give me a group certificate ( yet) but can scream blue murder no sick certificate .
And I said today so I need to call the tax department to dob them in .
They gotta learn before my accident I was such a good soldier 30 mins early to work every day they gave me the **** work .
Clicking their heels and I ain't running like a bitch back

I should also say after so many phone calls and text messages supposedly from coworkers last one I answered the way the lawyer said .
After that I blocked every phone number from my employer and every coworkers numbers they want me go through my lawyer

The Employer would be in breach of their legal duties by not issuing a PAYG (Group) Certificate. I thought employers have 2 weeks after June 30 to issue it.

Maybe remind them of that and that you'll go to the ATO seeking their advice.

That's what I thought legally I have advice not to talk to them .
I've gone through my lawyer they haven't answered yet except to say there is no certificate for after July 20 . My lawyer now has a copy of my Centrelink certificate up to late October 2016 .
Yep I did say to someone at my lawyers do I need to call the tax department.

Anyone else had an employer that hadn't paid then like me December 21 2015 .
Yet the employer is being hard done by
I'm awaiting a call or letter from Centrelink

But in my employers employ there is a person whose job to get work cover injured back to work " like now " . When told I was doing rehab 4 or 5 days a week when she asked where I said they come to my house . That got me that is not therapy she indicated my employer would be seeking me to have therapy at the rehab centre 8 hours a day for I think she wanted 7 days a week .
Now my therapy is at rehab not 8 hours a day thankfully .

I really don't get this employer guess they decided that make an example out of me .
Me I would like it finished even if all I do is go on the dole beats getting stressed over bull dust they ate throwing up .

And it's still not work cover
Hence the trial in the industrial court .
The other side could not agree with my lawyer in the industrial tribunal .
Never in my life have I been to a work function get a traumatic brain injury lost smell taste memory issues
Head spins eye spins light headedness lost my licence doesn't look like I'll get that back .
Yet my employer is hard done by
I've got nothing

I just had a thought that's a bad thing
My exemployer complaining they don't have a sick cert since July 20 . It's September now why wait so long .

Yet June 30 and they can't even email to me a group cert .
Yeah I was a paid slave

Ok on a better note kind of I've been asking doctors and therapists about putting a form into Centrelink .
I will not say what form all I heard since feb was no ,
Thought I'd ask the rehab doc well yes you can but are your main therapist
Now it's been filled in for months I'm not sure it's totally filled in correctly but rather than ask a therapist I put it it in yesterday.
If it's a yes answer it's a yes if it's a no then it's no .

I'm taking care of myself I'm over so called helpers that hinder me

Not having a good health day
Head spins or eyes from 11.49 pm to 4 am then 5 am then 6.30 am then 7.43
I listened to my kids don't go to therapy . Called them up they said I needed to see a GP or ER . GP had no appointment ms available until 2.45pm.
Off to the ER end result BP good ECG normal blood sugars good . The ER doc did the test I've had done for months and months eyes thankfully didn't roll .
Looked in my injured ear need to see an ENT doc again he will write a letter to that department.
And if I get head or eye spins for four hours off to the ER when it's going on .
Oh he thinks it's nerve damage due to one of the fractures from my brain injury .
I won't say what therapy rehab said unbelievable that mob .
I'm home and when that test doesn't do the eye spin until I go to bed I feel sea sick lucky me

And I'll let the lawyer know suspected nerve damage from the fractures of my brain injury

I went through some really bad times Sunday night Monday morning . I went to the ER as I said and they've referred me to the ENT . But was curious why I went to the ER told him therapy said I had to ,
Got through all that part way through Tuesday I was better ,
Wednesday caught buses to and from therapy .
I told therapists for months buses affected me nope got told rubbish don't look out windows look at the seat in front of you ignored me saying it affects me .

Yet go to an ER with eye spins or head spins I got the third degree but seeing I went to the ER .
I got told you can't catch buses home for love of mike lmao you can't catch buses due to your spins and ER visit .
Yet for months and months catch buses take pain pills .

Just thought I'd post that makes me feel better .

Ok I had a letter from Centrelink I left off some information I thought I did .
Contacted my lawyer spoke to his assistant they are sending me a heap of paper work to take into centre link
And the lawyer is now aware I was in hospital for two hours on Monday due to the ear injured in my accident which the ER doc blamed on nerve damage I hope that helps the fight

while im getting there i may never be 100 percent nonmedical therapists are saying thats not your brain injury but nerve damage how that suddenly changed over almost a year .
But ive applied for different benefits at centrelink seeing my old GP turned on me I moved on found a new one . But could not get a medical person help me fill in my form .
I got yes you can apply from a doctor but no help .
With my court case ongoing and the other side needing every medical record on me since Jesus roamed the earth .
After applying and the medical info being incomplete I supplied centrelink with copies of the medical info on me the lawyer had including 500 or more pages from the hospital.
To start with I told centrelink i needed help filling in the form due to my brain injury she called the other person up they demanded the 500 pages be copied and sent.
I went back two days later to pick up my info only to be told it was info overload and they needed to go through every page and find what they needed in the middle of the storm they called me to say i could go in pick it up i dont think ill walk there in this weather .
And on another note after my lawyer contacted my old employer still no group cert ive done what many of my friends have told me to do . I contacted my tax agent but its totally illegal for them not to supply you with one yes i know my lawyer contacted them and all they did was scream for sick certificates from july 20 still no group cert they went onto the ATO site yes its there i will take copies of emailed pay packets to back up the ATO or see if ive been ripped off .
Sorry guys long winded me just fighting back
I may never work again but i will never be that good soldier that gets to work 30 mins early every day get laughed at made fun of given one of the most boring jobs where i do the exact same thing every minute every hour every day every week every month every year for 21 years .
I'm still on their books send me a letter about 2016 EBA but cant send me or email me a group cert get stuffed you mongrels

Maybe your approaching this from the wrong angle Micky. Perhaps an approach to the Fair Work Ombudsman citing the Tax implications of not receiving the PAYG certificate, might be fruitful. Surely your lawyer would be looking at those things?

It is unfathomable why you haven't got a group certificate.

But you could be right
I also think the tax agent is contacting the ATO over this as well .

Basically all it is my exemployer ( I'm calling them that ) is flexing their muscles to prove they are right .

Funny you say that as well on the letter re the EBA there's a number for fair work I'll give them a call
Honestly I've done everything the correct way I'm standing in mud all I did was nearly die from a brain injury at a work function I'm a very low paid worker yet they are screaming blue murder ie I'm on their books not working so I'm costing them money by not working

What your taxable income is in 15/16 is what you have earnt. Irrespective of sick cerificates or any other document it won't change that. Sounds like a smokescreen.

That is why between the Fair Work Omb and the ATO, I would have thought they can take the Employer to task.

I tried couldn't get through to anyone then had rehab on the phone

Tax agent can do my tax ive got to copy my pay envelopes and the three that say zero certain one hours in leave disappear and my super money went up .

Honestly it's just my ex work waiting until I return hell even rehab said I should be back on work cover so instead it's I'm a liability to the company if I'm not 100 percent cause legally it's not work cover
If it was a Xmas party yes I would be
Costing this company money taking me to court rather than end it them not me

Seeing I couldn't contact the fair work omb
I went got my tax done he was shaking his head at what I've gone through
From the injury to the stress level work or exwork has put me through my tax agent couldn't believe it

But tax is done
Exemployer and their insurer ( known in Victoria as very non professional)
They are taking me to the industrial court
Reasons to see if a work function injury is work cover

So if it is so be it
So if it is not so be it

I am ready to get on with my life if that means on disability so be it
If it means on the dole until I'm old enough to retire on nothing so be it

Me going back to an employer that I've worked for over 21 years and swore for three months a non drinker was a drunk diabetic really surely some one on the **** jobs with me knew I don't drink

But it's in the courts now I'm waiting with baited breath

ok to give myself a little more time or room . I made it back to my GP wednesday afternoon . And she was aware a few weeks back i was back in hospital well the ED for 2 hours and due to that visit I have an ENT Tuesday afternoon fingers crossed for that .
While I was there I decided to ask about getting my car licence back GP couldnt help me seeing I get head spins etc but i need to contact rehab therapy as they may (I will add I had a near far due to light headedness this morning ) . So no help there .
Rehab said I could see my GP for a health plan i wont say what but yep thats underway have my first appointment towards the end of October .
That is two days after my Assessment at centrelink .
And seeing I got a phone call from rehab after they ended my therapy I said to the GP the truth they wish me to book myself back in why i have no idea seeing they ended my time there . But I told my GP after my centrelink appointment Id contact them and go back so I have a new Centrelink certificate to ensure I have time.
While i did all that Wednesday it was too late to take it to centrelink so I went there thursday all done on my file,
Contacted my lawyer do they need a copy in case my employer or exemployer whatever they are will scream for a another sick certificate lawyer has a copy . Also gave them a copy of the letter the ED doc gave me to give my GP just in case they need a copy saves them having to ask for it from the hospital which takes 45 days to get .
Ive learnt much since my injury
And yes I'm still in an industrial court case
Surely as a nobody a low paid worker it would have cost the employer and perhaps insurer less money to have me on work cover and light duties .
But I really dont know
Its cost me no money for
1 industrial tribunal
2 specialists one for my side one for their side
3 indsutrial court case and a barrister
Honestly do employers and insurance companies pay to go to industrial tribunals and industrial court .
And surely one had to pay for the nuerologist they forced me to see in favour of the company and insurer surely he changed them money to say what ive already said no smell no taste memory loss and certain things he never did tests on and said I wasnt , funny but i guess they pay money .
His decision on it not being work cover encouraged the other side to go to court .
Well thats it at present

Just an update a long week next week
Three appointments one at Centrelink and two specialists
No idea how it will go
Still no clue about the court case that's gone all quiet apart from the group certificate and sickness certificate .

The only thing I want to say along with thank you for all your good wishes
I do still get confused ect you don't need me to mention other stuff .

But I am rather confused with therapy I had therapy from December 2015 until late September 2016 . I was sent on my way a hand shake and a book of exercises to do .
Next day I get a phone call my main therapist was not aware my therapy ended funny that . Told me to book myself in for two more weeks no idea why haven't done it yet .
Move forward a few weeks ENT appointment three months early I'm still getting head spins ect . I know my accident was only 12 months yesterday ENT is sending me to a private place to get my balance tested and therapy sessions .
Honestly how much therapy do I need to do 10 months at a state government rehab place
Now suggesting more therapy .
I dunno I've been good done what I've been told how much more .
Honestly it's been like being at a job except they didn't like me asking for a lunch break I dunno .
